Alleged Theft of a Tub at Denaby Main

Eliza Brown was charged with stealing a tub valued at 3 shillings, the property of Benjamin Fellowes, at Denaby Main, on the 11th inst.

Mrs Warburton, with whom the defendant lodged, said on the evening in question defendant went out in the backyard and came back with a tub, saying she found it against the ash pit, and that if no one claimed it, it would do very well for herself.

When the police officer came to the house, defendant said if it belonged to anyone they could have it. She did not think that defendant meant to steal it, but she had merely found it.

Police Sgt Midgley said he went to Mrs Warburton’s house, and found the tub in the back kitchen. There was no attempt at concealment and defendant said she had found it.

Francis Fellowes, wife of prosecutor, said on the night previous to the theft she left the tub outside the back door. It might have rolled down to the ash pits.

The Chairman said in consequence of several excellent testimonials as to prisoner’s character, which had been received from the vicar, superintendent, and constable of Tunstall, Staffordshire, from which place the defendant came sometime ago, the Bench were prepared to deal leniently, and the defendant would be imprisoned until the rising of the Court.
