Denaby Main Colliery Company v Protector Lamp and Lighting Company

at the Doncaster County Court on Thursday last, the Denaby Main Colliery Company brought an action against the Protector Lamp and Lighting Company to recover £50 for loss sustained on the 13th and 14th of January through lamp supplied by defendants being extinguished.

Mr F Parker Rhodes appeared for plaintiffs, and Mr C.R. Hardman for the defendants.

It seemed that the defendant company supplied a quantity of gasoline in quantities of 10 gallon in tanks for use in colliers lamps. The lamps went out, thus reducing the output of the colliery from 1500 to 1150 tons.

Plaintiffs alleged that the oil was bad.

For the defence it was argued that the plaintiff cisterns must have been out of order, but His Honour held that it was scarcely a reasonable defence, and gave a verdict for the plaintiffs for the full amount.
