Obstructing the Highway at Conisboro’

Robinson Crabtree, surveyor to the Doncaster Rural District Council, was summoned for having obstructed the highway at Conisboro’ on the 13th July.

Mr. W. Baddiley appeared for the defendant.

P.C. Thompson stated that on the date mentioned he was on duty in Park Road, in company with P.C. Horton, when they saw several heaps of stones.

There were no lights on the roads, and the stones were very dangerous.

On the following evening they measured the heap of stones and found it 190 yards long.

The road was 13 feet wide, and five feet of it was covered by the stones.

The second heap was 95 yards long and covered five feet out of 19.

The third lot was 120 yards, the road being 17 feet 6 inches wide.

There was a considerable amount of traffic, and when witness spoke to the foreman of the works, he said that in accordance with the surveyor’s orders the stones were placed upon the road.

Witness eventually saw defendant and told him he would be reported.

Cross-examined by Mr. Baddiley, the defendant commenced to remove the stones on the following day.

P.C. Horton gave corroborative evidence.

Mr. Baddiley said he was not going to deny that the stones had been placed upon the road, but the Bench were aware of the fact that new houses were being erected there and there must be a certain amount of material deposited.

John D. Stevens, the foreman, stated that fully 13 feet of the road was left uncovered by the stones.

Witness and defendant had measured the road, which was 22 feet wide at the narrowest point.

The Chairman said the Bench considered that an obstruction had been caused, and the defendant would be fined 10s., including costs, which amounted to 11s. 6d.
