The Denaby Strike
Appeal Again Postponed
Before the Master of the Rolls and Lords Justices Stirling and Mathew, in the Court of Appeal, on Thursday.
Mr. Rufus Isaacs, K.C., asked leave to mention the case of Denaby and Cadeby Main Collieries, Limited, v. Yorkshire Miners’ Association, which stands in the list of new trials. He said it was an appeal by the Colliery Company asking for judgment or new trial on appeal from the verdict and judgment entered in the trial in February last, when the action was tried by Mr. Justice Lawrence and a special jury.
His application was that it might stand over until after judgment had been given in the House of Lords in the case of Howden v. Yorkshire Miners’ Association (the stop day case), as the decision of the House of Lords must have an important bearing on this appeal. In any case, he asked that it should not be in the list for hearing until after July 28th.
Mr. Montague Lush, K.C., for the respondents, said he did not oppose the application.
