Action Against a Railway Company for Damages

Yesterday at the Barnsley Police Court, Charles Walker, farmer, of Penistone, sued the M.S. and L. Railway Company to recover £9 damages for the loss of three sheep which were killed in transit and three which were injured.

On the 23rd of March last plaintiff consigned a number of sheep to the defendants to carry to Conisboro’. They started from Penistone at ten o’clock in the morning, and arrived at six o’clock in the evening.

It was then found that three sheep were dead and several injured, owing to the train having to be frequently shunted for coal trains.

The defence was that plaintiff’s servant was in charge of the sheep, and was responsible for them.

His Honour reserved his judgment.
