For having failed to close a market stall at 8 p.m. Joseph Whybrow, a Rotherham fruiterer, was fined 10s. at Doncaster on Tuesday.
A County Council inspector said that last Friday he visited Denaby Main market and at 8-25 p.m. went to defendant’s stall where defendant and two assistants were selling apples at two pounds for 2½d. to a crowd. Defendant was asked if he knew it was after 8 o’clock and he replied that he had not heard the bell go.
At this market, however, there was no warning bell but witness added that he had since made arrangements with the market superintendent whereby the stall lights were to be switched off as a warning of closing time.
“At the time when I approached defendant’s stall all the other stalls were in operation but after I had appeared on the scene they immediately closed and I could not get any further than defendant.”
