Alleged Highway Obstruction.
William Smith, grocer, Conisboro’, was summoned for obstructing the highway at Conisboro’, on the 22nd inst.
Mr. Hall appeared for the defence.
Charles Kitchen, in the employ of Messrs. Nicholson, brewers, said when he passed the defendant’s shop on the above date there was a wheelbarrow standing outside, which he ran against. That was at half-past seven, and he saw it there at ten to eight and also after ten o’clock, at which time he called the attention of Sergeant Calcraft to it. The wheelbarrow was just on the edge of the causeway.
Sergeant Calcraft said the last witness called his attention to a wheelbarrow near the defendant’s shop which was standing on the side of the road close to the footpath.
Mr. Hall contended that there was no evidence that the barrow stayed on the highway for an unreasonable length of time. All that was done was that the barrow was used for taking out groceries, and it simply stood there during the time that it was loading.
The Bench were of opinion that the barrow was not there an unreasonable time, but cautioned the defendant for the future, and dismissed the case.
