Assault on a Discharged Soldier

At Doncaster, on .Saturday, Michael Carmody was sent to prison for a month for assaulting Edward Davis, another miner, and discharged soldier.

Mr. Frank Allen said the parties had been working together in the same stall, but defendant had always been disagreeable and had caused disturbances, so the other men complained to the management, who took defendant away and placed him on the ” market.”.

He had taken it rather badly, and had threatened complainant, frightening him considerably.

Davis had suffered from wounds, rheumatism and shell shock, and was unable to work more than four shifts a week. The previous Saturday defendant used most offensive language, and when Davis said he did not want any bother he struck him in the eyes, knocking him down -and striking him several times,. When Davis got outside  defendant struck him again.

The defence was that there had been trouble over some money, and defendant said he asked the management to move him out of the stall.

On this day, Davis was the aggressor, for he had used some bad language and “squared up” to him. He admitted he had struck him, but it was to avoid him being struck.
