Cadeby Strike Summonses
Colliery Companies Generous Action
The recent dispute at Cadeby Colliery had a sequel at Doncaster West Riding Court on Tuesday, when Mr A. S. Furniss, for the Amalgamated Denaby Collieries Co., Ltd., applied for the withdrawal of summonses against 171 persons for alleged breach of contract.
Mr. Furniss said that the claims were for damages or breach of contract in connection with a lightning strike, where the boys came out in sympathy with another boy who had been summarily dealt with. The claims were for amounts between 10 shillings and 30 shillings, subsequently amended to claims for £3 or £4 against each defendant. By arrangement between Mr. Herbert Smith and a representative of the colliery company these had been settled on terms which need not be mentioned before the court. He therefore asked the summonses to be withdrawn.
Mr. Furniss also asked for the cost to be remitted. Agreed settlement, he said, was lamentably the advantage of the 171 defendants, and the position was, he expected, that the company will be mulcted for the cost and the cost of the withdrawal of the summonses. This
Mr. Donald Dunn, who appeared for the defendants, said that no provision was made in the terms of the settlement for costs, and the people who commenced proceedings must of course, pay costs.
The bench decided to remit half of the cost.
