Claim Against Denaby Explosives Company

Yesterday, before Judge Masterman, at the Doncaster County Court, D. Bailey, traveller, sued the Fortis Powder and Explosives Company (Limited) for £16 17s. 6d. for commission. Mr. Gildard, of Rotherham, was for plaintiff, and Mr. Baddiley for defendants.

Plaintiff was employed by the defendants’ predecessors as an expert and traveller, and was then paid a weekly salary and travelling expenses. The defendants retained plaintiff’s services, but after some time the terms of the engagement were altered, plaintiff to receive commission alone.

An agreement was produced whereby defendants agreed to pay 10 per cent. commission on all sales, and his Honour gave judgment for plaintiff for the full amount.
