Colliery Prosecutions at Denaby

Ernest Davies, collier, Denaby, was summoned at the instance of the Denaby Main Colliery for having committed a breach of Colliery Special Rule 90.

The offence according to Mr Gichard, who prosecuted, consisted of the defendant having neglected to provide backstay breaks to ensure the safety of a number of corves proceeding down an incline. By his neglected boy was injured.

Counsel added that the colliery people did not wish to press the case.

The defendant, having pleaded guilty to the charge, was ordered to pay the costs which amounted to 11s 6d. The date on which the offence was committed did not transpire.

John Westwood, driver, Denaby, pleaded guilty to having committed a breach of Colliery Special Rule 66, and was mulcted in a similar penalty.

Lawrence Killahieney, filler, also Denaby, was the defendant in the summons charging him with having committed a breach of Colliery Special Rule 106.

Mr Gichard explained that the defendant and sustained action, and now was in the Montagu Cottage Hospital at Mexborough. The injuries he had received were achievable to his neglect, and it was in consequence of that negligence that the present proceedings have been instituted. It was a very flagrant case of neglect, but as the defendant condition did not allow of his being in attendance for at least a week, he applied for the hearing of the case to be adjourned.

In the last two cases the complainants were also the Denaby Main Colliery Company, of whom Mr Gichard appeared.
