Drunk at Mexbro’

Saml. Utley, labourer, Mexbro’, was charged with being drunk at that place, on the 21st ult.

P.C. Moore deposed that on Sunday, the 21st ult., about 1.50 p.m., he was on duty in High-street, Mexboro’, and there saw defendant coming from the direction of Doncaster-road very drunk, reeling along the footpath. Passengers had to turn off in order to let him pass. Told him he should not get drunk on a Sunday, and he replied saying, witness might go to h—. Mr. Hall defended.

Saml. Utley said on the day in question he had been working at the boilers at Denaby Main. Went to work at 6 in the morning, and came away at half-past 12 at noon. He expected his dinner at the Club House. Went there to have his dinner. Remained there waiting for his dinner and it never came. He had no drink at the house. Met Moore and he said, “It’s Club House again, Sam.” Told him he had nothing to do with it. He had no beer up to going to the Club House, and none there.

Elijah Scott deposed that defendant was a member of the club. He had no drink there at all.

Case dismissed.

Mr. Hall asked for costs, but they were refused.
