Employer and Workmen’s Act.

Thos. Vickers was summoned for neglecting his work on three days during the present month. Mr. Rhodes appeared for the prosecution.

Wm. Oswald, a deputy employed at the Denaby Main Colliery, said the defendant was a horse driver. On the 2nd August the defendant took his horse out of the stable and went to his usual working place. He had been working there for several months. He had had a conversation with him a fortnight previously, and had raised his wages 2d. daily.

Defendant wanted more money, and witness told him he must give notice. He then ordered the defendant to work, but he would not go. He could not get anyone to take his place, and in consequence of the defendant’s conduct they lost the use of the horse.

Mr. Ald. Clegg (Sheffield) cross-examined the witness, who stated that another boy had 3s. a day because his working place was wet, and Mr. Oswald wanted him to work in the “water hole.”

The case was dismissed.
