Infringing Special Rule 106 at Cadeby

For infringing special rule 106 at the Cadeby Colliery, on the sixth of November, Edwin Ball, a driver, of Denaby, was charged with that offence.

Mr. F. Allen, prosecuting, stated that defendant had taken four full tubs down an incline, whereas only throe should have been taken. The number of tube which should be taken down the incline varies according to the grain. Notices stating the number of tubs to be taken were placed near the incline.

Robert Whitlam, assistant horsekeeper said that he saw the defendant driving four tubs down the incline on the day in question.

Defendant stated that there was no notice up on that particular incline.

Harold Jackson and Bertram Cashmore corroborated defendant’s statement.

Ball was fined 5/6 and 15/6 costs or 10 days.
