Rate Summons.
Order against Denaby Man
Frank Guest, manager of the Reresby Arms, Denaby, was summoned at Rotherham West Riding Police Court on Monday, to show cause why he should not be committed to prison for failing to pay general rates as was ordered in September, 1930. The amount owing, with costs was £13 19s.
Mr. A. H. Jackson (solicitor), who prosecuted on behalf of Swinton Urban Council, said defendant was at one time tenant of a beer-off licence at 231, Wath Road, Swinton and left owing rates amounting to £13 4s. 5d.
He called at the collector’s office and tendered £10, and when the collector was going to give him a receipt he said that unless he received a receipt in full settlement, he would not pay. The collector was not authorised to do that, and defendant picked up his money and went away. He was now in receipt of £5 a week as manager of the Reresby Arms.
Mr Dunn (solicitor), Messrs Fenoughty, Dunn and Co., Rotherham, for defending, said his client denied that he asked for a receipt in full settlement. He had offered to pay the sum in instalments, but the collector refused to take it that way. Defendant was not in a position to pay the whole sum down, but made an offer of 30 shillings a month.
The magistrates made a committal order, to be suspended so long as defendant paid 40 shillings a month.
